1. Scope and relationship with other documents
1.1 This Disclaimer applies to the website at [WEBSITE URL] and to other Alphapay webpages, applications, social-media pages and digital materials that link to it (collectively, the “Site”). The Site is operated by ALPHAPAY TECHNOLOGY LIMITED (“Alphapay”, “we”, “us” and “our”).
1.2 The Site provides general information about Alphapay and its business money services. Use of the Services is governed by Alphapay’s Business Money Services Terms and Conditions (the “Terms and Conditions”), the applicable Application Form, each Order Confirmation and other incorporated documents. Personal Information is handled under the Privacy Policy. Complaints are handled under the Complaints Handling and Management Policy.
1.3 If this Disclaimer conflicts with a binding agreement for the Services, the binding agreement governs the relevant Service or Order. The Privacy Policy governs the handling of Personal Information. Nothing in this Disclaimer excludes a mandatory right or remedy under Applicable Law.
2. General information only
2.1 Site content is provided for general informational and promotional purposes. It does not constitute legal, tax, accounting, investment, financial-planning or other professional advice and should not be relied on as a substitute for advice based on a person’s particular circumstances.
2.2 Alphapay provides money-remittance and related foreign-exchange services as described in the Terms and Conditions. Alphapay does not provide investment advice or supply currency for speculative or investment purposes. References to a product, payment method, currency, country or transaction type do not constitute a recommendation or assurance that it is suitable, lawful or available for a particular person.
2.3 Nothing on the Site constitutes an offer, acceptance of an application or Order, guarantee of onboarding, promise of credit, deposit-taking arrangement or fiduciary undertaking. An Order becomes binding only when Alphapay issues an Order Confirmation in accordance with the Terms and Conditions.
3. Rates, fees and service information
3.1 Any exchange rate, fee, processing time, delivery time, corridor, limit, availability statement or other service information displayed on the Site is indicative unless Alphapay expressly identifies it as binding. Rates and availability may change before an Order is accepted. The applicable Order Confirmation and fee disclosure govern the relevant transaction.
3.2 Actual delivery may be affected by cut-off times, funding, identity and compliance checks, banks, correspondents, payment networks, recipient institutions, holidays, time zones, third-party charges and events outside Alphapay’s reasonable control, as described in the Terms and Conditions.
3.3 The user is responsible for confirming beneficiary, account, routing and purpose-of-payment information before submitting an Order and for reviewing the applicable agreement, quote and Order Confirmation.
4. Regulatory information
4.1 Alphapay will provide regulated Services only after obtaining, and while maintaining, every registration required by Applicable Law. Alphapay’s FINTRAC registration particulars will be disclosed in the Terms and Conditions and other approved materials once verified.
4.2 Registration with the Financial Transactions and Reports Analysis Centre of Canada (“FINTRAC”) is not a licence, guarantee or endorsement by FINTRAC. Information on the Site must not be interpreted as stating otherwise.
4.3 Alphapay may restrict access to the Site or Services in a jurisdiction where access, marketing or provision of the Services would be unlawful or inconsistent with a regulatory, sanctions, banking or payment-network requirement. A user is responsible for complying with laws that apply to the user’s access and activities.
5. Accuracy and updates
5.1 Alphapay uses reasonable efforts to keep material Site information accurate and current. However, Site content may contain errors, omissions or outdated information, and may change without notice. Alphapay does not warrant that every item of Site content is accurate, complete, current or suitable for a particular purpose.
5.2 Alphapay may correct, suspend, withdraw or update Site content at any time. Alphapay has no duty to update archived, historical or third-party content except where Applicable Law or a binding agreement requires it. A material change to the Terms and Conditions or Privacy Policy will be handled under the amendment provisions of the relevant document.
6. Site availability and cybersecurity
6.1 Alphapay uses reasonable administrative, technical and physical safeguards, as described in the Privacy Policy, but no website, electronic communication, network or storage system is completely secure or continuously available. Alphapay does not guarantee uninterrupted, error-free or malware-free access to the Site.
6.2 Users should protect credentials and devices, use available authentication controls, verify the source of communications, avoid sending sensitive information through unapproved channels and notify Alphapay promptly of suspected fraud, impersonation, unauthorized access or security incidents.
6.3 Email and other electronic communications may be delayed, misdirected, altered, monitored or intercepted. Nothing in this clause reduces Alphapay’s obligation to use safeguards appropriate to the sensitivity of Personal Information or to comply with applicable privacy and breach-notification laws.
7. Third-party content and links
7.1 The Site may contain links to third-party websites, applications, payment methods, networks, social-media platforms or resources. Unless expressly stated, a link does not mean that Alphapay controls, sponsors, endorses or guarantees the third party or its content, availability, security, privacy practices, products or services.
7.2 A user accesses third-party services at their own discretion and should review the third party’s terms and privacy notices. Alphapay is not responsible for third-party content or conduct outside its reasonable control, but this does not limit responsibility that cannot lawfully be excluded or responsibility expressly assumed in a binding agreement.
8. Intellectual property and permitted use
8.1 The Site and its original text, graphics, software, interfaces, databases, designs, logos and other content are owned by or licensed to Alphapay and are protected by intellectual-property laws. Third-party names and marks remain the property of their respective owners.
8.2 Alphapay grants a limited, revocable, non-exclusive and non-transferable permission to access and use the Site for lawful business-information purposes. Except as permitted by law or with prior written consent, a user must not reproduce, modify, scrape, republish, distribute, sell, reverse engineer, frame, mirror or commercially exploit the Site or remove proprietary notices.

9. Limitation of liability
9.1 To the maximum extent permitted by Applicable Law, Alphapay is not liable for loss arising solely from reliance on general Site content, inability to access the Site, or third-party content or services outside Alphapay’s reasonable control. This exclusion does not apply to the extent a loss was caused by Alphapay’s breach of a binding agreement, negligence, fraud or wilful misconduct.
9.2 To the maximum extent permitted by Applicable Law, Alphapay is not liable for indirect, incidental, special, exemplary, punitive or consequential loss, or loss of profit, revenue, business, opportunity, goodwill or anticipated savings arising from the Site. This clause is intended to be consistent with clause 10 of the Terms and Conditions and does not exclude liability that cannot lawfully be excluded.
9.3 The Site is provided on an “as available” basis. Any warranty, representation or condition not expressly stated is excluded to the maximum extent permitted by Applicable Law. Express commitments in the Terms and Conditions, an Order Confirmation or another binding agreement are not displaced by this Disclaimer.
10. Privacy, communications and complaints
10.1 Alphapay’s collection and handling of Personal Information through the Site is described in the Privacy Policy at [PRIVACY NOTICE URL]. Cookie and similar-technology choices, where available, are described there or through the Site’s cookie-preference tool.
